RETURNS AND REFUNDS POLICY

  1. OUR COMMITMENT

Swan Pools complies with the Consumer Protection Act 68 of 2008 (“CPA”) and the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”).

This policy explains your rights regarding returns, exchanges, repairs, replacements and refunds.

  1. ONLINE PURCHASE CANCELLATIONS

In accordance with ECTA, customers who purchase products online may cancel their order within 7 days of receiving the goods.

To qualify for cancellation:

• The goods must be unused.
• The goods must be returned in their original packaging.
• All accessories, manuals and components must be included.
• The goods must not be damaged.

The customer will be responsible for return shipping costs unless the goods are defective or supplied incorrectly.

  1. DEFECTIVE PRODUCTS

In terms of Section 56 of the Consumer Protection Act, customers may return defective goods within six (6) months of delivery.

If a product is defective, unsafe or unsuitable for its intended purpose, the customer may choose one of the following remedies:

• Repair
• Replacement
• Refund

This right applies in addition to any manufacturer warranty.

  1. PRODUCTS DAMAGED IN TRANSIT

Customers must report transit damage within 48 hours of delivery.

Photographs and supporting documentation may be requested to process claims.

  1. INCORRECT PRODUCTS SUPPLIED

If Swan Pools supplies an incorrect product, we will arrange collection and replacement at no cost to the customer.

  1. NON-RETURNABLE PRODUCTS

The following products cannot be returned or refunded unless they are defective, damaged, incorrectly supplied, or otherwise returnable under the Consumer Protection Act:

• Custom-manufactured pool covers
• Custom-sized thermal blankets
• Roller systems manufactured to customer specifications
• Made-to-order products
• Cut-to-size materials
• Special-order imported products
• Products altered after delivery
• Products installed after delivery where the issue is unrelated to a manufacturing defect

  1. EXCLUSIONS

Returns, refunds or warranty claims may be declined where the product failure resulted from:

• Improper installation
• Incorrect use
• Negligence
• Chemical damage
• Electrical surges
• Lack of maintenance
• Unauthorised modifications
• Normal wear and tear
• Failure to follow manufacturer instructions

  1. WARRANTY CLAIMS

Warranty claims may require:

• Proof of purchase
• Product photographs
• Inspection reports
• Return of the product for testing where necessary

Warranty claims will be assessed in accordance with the manufacturer’s warranty conditions and the Consumer Protection Act.

  1. REFUNDS

Approved refunds will be processed using the original payment method where reasonably possible.

Refunds may take several business days to reflect depending on the payment provider or banking institution.
