  1. PRODUCTS

3.1 Swan Pools sells pool-related products including but not limited to pool heating systems, pool covers, pool pumps, pool accessories, thermal blankets, roller systems and related equipment.

3.2 We strive to ensure that all product descriptions, specifications, photographs and pricing displayed on the website are accurate.

3.3 Product photographs are provided for illustration purposes only and may differ slightly from the actual products supplied.

3.4 Swan Pools reserves the right to discontinue products or amend specifications without prior notice.

  1. PRICING

4.1 All prices displayed on the website are in South African Rand (ZAR).

4.2 Prices include VAT where applicable unless expressly stated otherwise.

4.3 Delivery charges are calculated separately and displayed during checkout.

4.4 Swan Pools reserves the right to correct pricing errors and may cancel orders resulting from obvious pricing mistakes.

  1. ORDERS

5.1 Submission of an order does not constitute acceptance of that order.

5.2 An order shall only be deemed accepted once payment has been received and an order confirmation has been issued.

5.3 Swan Pools reserves the right to refuse or cancel any order due to:

• Stock unavailability
• Incorrect pricing
• Payment issues
• Suspected fraud
• Any other legitimate business reason

  1. PAYMENT

6.1 Payments may be made using the payment methods displayed on the website at the time of purchase.

6.2 All online payments are processed through secure third-party payment gateways.

6.3 Swan Pools does not store customer payment card information.

  1. DELIVERY

7.1 Delivery times are estimates only and are not guaranteed.

7.2 Delivery timeframes may vary depending on product availability and location.

7.3 Risk in the goods passes to the customer upon delivery.

7.4 Ownership of the goods remains with Swan Pools until full payment has been received.

7.5 Customers must inspect goods upon delivery and notify Swan Pools within 48 hours of any visible damage, shortages or delivery discrepancies.

  1. INSTALLATION

8.1 Unless specifically stated otherwise, products are sold without installation.

8.2 Customers are responsible for ensuring products are installed according to manufacturer specifications and industry best practices.

8.3 Swan Pools shall not be liable for damage, loss or reduced product performance caused by:

• Incorrect installation
• Improper use
• Unauthorised modifications
• Neglect or abuse
• Failure to follow manufacturer instructions

  1. WARRANTIES

9.1 Products may be supplied with manufacturer warranties where applicable.

9.2 Warranty periods and conditions vary according to the manufacturer and product type.

9.3 Warranty claims may require inspection, testing and proof of purchase.

9.4 Nothing in these Terms and Conditions limits any rights granted to consumers under the Consumer Protection Act 68 of 2008.

  1. LIMITATION OF LIABILITY

10.1 Swan Pools shall not be liable for indirect, consequential, incidental or special damages arising from the use of its products or services.

10.2 Swan Pools’ maximum liability shall not exceed the amount paid by the customer for the product giving rise to the claim.

10.3 Nothing in these Terms excludes liability where such exclusion is prohibited by South African law.

  1. INTELLECTUAL PROPERTY

All website content including text, graphics, logos, images, product descriptions and website design remains the property of Swan Pools and may not be copied, reproduced or distributed without prior written permission.

  1. PRIVACY

Swan Pools processes personal information in accordance with the Protection of Personal Information Act (POPIA).

Customer information is used only for legitimate business purposes including order fulfilment, customer service and legal compliance.

  1. GOVERNING LAW

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of the Republic of South Africa.

Should any dispute arise between Swan Pools and a customer, the parties agree to attempt to resolve the matter amicably.

• Any other competent authority or court having jurisdiction
